>> moment of impact, amtrak train including with big rig stuck on the tracks, it is a moment real passengers from philadelphia won't soon forget. >> i heard all of the noise land very quickly. >> happened monday in north carolina it derailed cars. clinton jackman was in the car, and he said the first car left standing on the tracks. >> once we hit of course it was a thrust, great momentum. >> at least 40 hurt, dozens taken from the crash scene to local hospital, others rushed on shuttle buses. >> on the train for about two two and a half hours, and they took us to the hal fax community center. they fed us, and sort of, you know, continued to brief us on what was going on. >> fortunately, authorities say no one suffered life threatening injuries. all of us feel fortunate, you know that nobody was really,

really seriously seriously hurt. >> the train traveling from charlotte to new york with a stop in philly had 212 passengers and eight crew members on board. what was a terrifying afternoon then turned into a long night as travelers tried whatever they could to get home. >> i got back on, just ready to come up. >> yes, he eventually did hop back on a train says he's not trade to do so. in the meantime, that train usually runs from charlotte to newark we're reporting live at 30th street station, jan carabeo, cbs-3, "eyewitness news". >> jan thank you for. that other news this morning fire at vacant building building in west philly lands a man behind bars on suspicion of arson. "eyewitness news" was there when that man was taken into custody. he's accused every setting a fire at this vacant building on hutton street near fairmount avenue shortly after 3:00 this morning. that fire was quickly

extinguished. no injuries were reported. still, no word yet on funeral plans for philadelphia police officer robert wilson. yesterday evening neighbors held a vigil in front of the north philadelphia store where he was shot and killed last thursday. officer wilson stopped in the game stop to buy his son a video game, when two men walked in, and tried to rob the store. he took several rounds, but kept on firing. >> we lost really good guys good friend, more importantly good father. >> officer wilson's son turned ten yesterday. he's also survived by a one year old child and a grandmother, two suspect are charged with first degree murder. >> 5:03, we want to get traffic and weather together. kate, grab the umbrella buff head out the door? >> grab the umbrella, it with you, you will need it by this afternoon. tracking chance for the threat for little bit every ice out on the roadways this morning not because every any rain coming in, but really because of the warm weather we had

yesterday, and all that melting snow. let's take a look outside see what's happening in our roof camera. this is "skycam 3" looking out of course over the city of philadelphia from the cbs studios, look pretty quiet out there right now clouds moving, in may even see few breaks of sunshine early this morning, if we can get that sun up, before the clouds really come in, our sunset hour later or sunrise an hour later now. so we may end up just cloudy all day long. notice the rain starting to push in, it is still well off to the south and west, couple leading edge showers to get in seen. we expect the steadiest of the rain to get in late this afternoon. in the the temperatures 33 at the airport, 32 in wilmington, 31 in reading around the freezing mark. a lot of melted water out there, thanks to all of that snow melt yesterday. temperatures around freezing, any of the icy spots any of the wet spots on the roads will be ice think morning so just be safe if you're out and about early this morning especially before temperatures rise, and anything that looks wet expect that it may be icy. now, we check in with jessica. good morning. >> good morning everybody

one, happy tuesday we're doing okay, in terms of our majors and the area roadways, they are looking okay, they're not really having a lot of volume on any of them. as you can see on 95, right around girard avenue, the southbound lanes where the heads light are looking okay, northbound, doing just as well. over on the ben franklin bridge, we have all lanes open so no problems headed in or out of the city. you can see westbound moving along nicely there no problems headed eastbound but we are scheduled for a burlington bristol bridge opening actually right now so you can expect some residual delays in or out of the area. out in chester county, an accident in west vincent route 401 closed at saint matthew's road. take horse shoe trail to get on by. back to you. >> jess, thank you. developing right now search underway for montgomery county woman. she vanish after her car broke down friday night. days for the family every dread a, they say she's left home before for few hours but never this long, of course, never days. let's take to you video now she was last seen leaving her royersford home at about 7:00 p.m. friday. her family says that she got behind the wheel of her sister's black mazda sedan that car was later found stalled at the 4227 he-76 interchange 7:20 p.m. friday. it was found by state police and later searched by the upper providence police department. they found no sign of 20 year old magolon. her family very worthied morning, take a listen. >> the days go on, it is just -- you just don't know, you jest rack your brain and we just pray she's safe. >> coming as some relief, no sign of foul play fawn at this time. and now police are trying to check out some tips that magalon may have been seen on her phone or perhaps hitchhiking between friday and saturday. we are live at the upper providence police department

justin finch cbs-3 "eyewitness news". >> thanks, justin, we'll get back to you shortly. an autopsy confirms the 13 year old delaware county boy found dead on his parent property killed himself. the medical examiner said cayman shot himself with a gun from his newtown square home. the eighth grader left home after getting bad progress report from school. grief counselors will be available for his classmate all week long. >> 5:07 right now. near miss for a man riding a atv through the street of northeast philadelphia, and check out your screen right here. quite dangerous. you can see that rider nearly slams head on into a motorist trying to make a left-hand turn. now, the back tires of the atv clips the front of the car just little bit there but then the rider maintains control, just keeps going. police later track that riders to a building on princeton street, oxford circle, and placed him under arrest. again, it is illegal to operate atv's in philadelphia. >> investigators are trying to determine what sparked this

three alarm fire in montgomery county. chopper three over landscaping company at 400 north park avenue in eagleville. firefighters got the call around 8:30 last night it took them about three and a half hours to bring the flames under control. no reports of injuries. nobody hurt. >> well, water crews will be out in the talcony section this morning to fix this broken water main you can see the water flowing down walker street last night after that main broke. crews shut off the water and they plan to repair the main after the sun comes up this morning. >> still ahead this morning several local lawmakers expected to face charges today. the crimes they are accused of committing while in office. >> also, we have to punishment for fraternity caught singing a racist chant. they are the student seen in that controversial video. they could face even more discipline. >> also, it is almost impossible to avoid hitting those rim rattling potholes on the road. we'll show you the pothole killer that will help make your ride a little smoother. >> and after getting a taste

especially in the colder suburbs, like chester springs, watch out for few icy spots there. >> sun up in time, we may see little sunshine this morning but not too optimistic. take a look what's is headed our way. we are cloudy all day long, it will be mild as the warm air starts to lift, in but tracking some steady rain through the evening hours and into tonight specially. so temps right now 32 in wilmington, 33 in philadelphia, notice again how chilly it is in our suburbs by 4:00 p.m. that first band of rain really starting to push in, it will impact the evening commute with heavy rain falling all across the area during the evening commute. it continues until about midnight before it finally starts to winds down, biment time we go on air tomorrow morning we will be seeing the rain move away eventually, some brakes in the cloud cover with highs getting into the 60s tomorrow. today not that bad at 54 degrees, it is cloudy, though, and watch for that rain heavy through the afternoon and evening. coming up your seven day but first we check on the roads jessica, good morning. >> good morning everyone, 5:14. and happy tuesday.

it will be a nice day out there, starting things offer where we are not dealing with a whole lot of volume on the ben franklin bridge, no real problems headed in or out of the city, and all lanes are open. so definitely, good thing over on 95, right around cottman avenue, no problems working through the work zone here southbound. no problems headed northbound, as women, there is an accident though, out in chester county route 401 closed at saint matthew road. take shores shoe trail to get by. that will out in new jersey black horse pike actually closed, due to an accident, with a downed pole, in the area at evesham road. take atlantic avenue to get on by. otherwise new jersey water main break, tying things up on big oak road, that's closed between wood born and chance are you, take killborn to get on by. over to you. >> thank you amtrak says, it will clear yesterday's north carolina trail de rainment later today. service to the area has been delayed. northbound train hit a tractor-trailer, stalled on the tracks near the virginia border yesterday afternoon.

fifty-four people were injured, but those injuries are not life threatening. >> one person is in custody for suspected arson after a fire in a vacant house on hutton street west philly. fire broke out before 3:00 a.m. there were no injuries. >> and the search is on for 20 year old deidra magolon. last seen friday. her car was abandoned in king of prussia. if you have seen her you are asked to call police. >> as we continue this morning, weaver exclusive information about the pope visit to philadelphia in september. >> we'll tell but the local landmark he's plan to touring during his trip to the city of brotherly love. >> entertainer bill cosby has a message for his fans. hear what the comedian says as abuse allegations continue to mount against him. we'll be back.

three days to decide page winslow killed the woman back in 2011. she died of complications after winslow gave her an illegal silicone injection in her buttocks at a hotel near the airport. police say winslow was motivated by agreed. it made us sick to our stomachs that some human being can do, that she deserves as much time as she can possibly get in jail. >> she wanted to do a good job, wanted to help, and i absolutely believe that, it is just what she was doing didn't lead to good things. >> prosecutors say winslow enticed clients by lying about being a nurse practitioner. she'll be sentenced in june. >> happening today two pennsylvania lawmakers, one former representative, expected to be formally charged with corruption related offenses recommended by a grand jury. philadelphia district attorney, seth williams, will make the announcement in a news conference, now the charges stem from an uncover sting investigation involving cash and gift. all three lawmakers democrats who serve philadelphia.

cosby of drugging and sexually assaulting them. cosby has not been charged with any crimes. 5:23, we want to click in with katie with the latest on the rain showers kate? >> that's right. we have rain moving this this afternoon, erika but one thing to watch this morning watch for icy spots. another time lapse video here there is one from the east coventry elementary school yesterday in pottstown, watch the snow, again melting and eroding off the grass and notice how wet that road gets. take a look at the parents lining to up pick up the kids. the road covered in puddles so any of the puddles any of the melted snow this morning in sub that's are below freezing like pottstown, watch for those isolated icy spots the roads dried out little bit, but still watch for slow downs, slick spots this morning. storm scan3, the rain headed our way notice the big shield of precipitation down through portions every kentucky, tennessee right now in our area just some cloud cover we don't expect this until around the lunch hour, then we do have some changes as we head through the forecast, so, today, 54 degrees, rain in the

afternoon, and evening, could be heavy at times but look at tomorrow. looks like clears out tomorrow. may get sunshine back, will help us get to 61 for the high thursday, 51, some sun then another chance for rain friday, into saturday, now we check on the roads this morning with jessica, good morning. >> hey, good morning. good morning everybody, we start things off where we're doing really okay out on a lot of the area majors, still early, though, you can see on the schuylkill expressway, right around city avenue, no real problems, and the westbound lanes headed into king of prussia. you can see up top as well, no real problems in the eastbound lanes as well. over on the 42 freeway out in new jersey starting to see volume gather at the top of your screen, headed northbound into 295 the surround area bridges, and that tends to jam up from depford up on in northbound a little bit later. but currently doing okay. the tac-pal is going to be opening, around 5:30 to 6:00 a.m. so definitely we keep you updated on that for some visit all delays, betsy ross bridge to get on by that for just right now. out in west vincent route 401 closed at saint matthew's road
